Terms of Sale

1. GOVERNING TERMS: All Defining Elegance LLC (www.definingelegance.com) sales shall be governed by the terms and conditions stated herein which supercede any representation or prior communications.

2. PRICING AND PAYMENT: Prices are subject to change by us without notice. We are not responsible for typographical errors on the web site.

SPECIAL ORDER ITEMS: Special order items are defined as non-stock items that must be ordered through the manufacturer. Special order items require 60% down, due at the time the order is placed. The balance will be charged the day of shipping.

CUSTOM ORDERS: Custom orders are defined as customized sizes or products identified as custom made. Custom order items require 60% down, due at the time the order is placed. The balance will be charged the day of shipping.

OUT OF STOCK ITEMS: If stock is not available either in our warehouse or the manufacturer's warehouse, it must be ordered. Out of stock items require a $25.00 deposit due at the time the order is placed. The balance will be charged the day of shipping.

3. LEAD TIMES: Most in-stock items ship within 2 days to 2 weeks. Please allow 5-10 weeks for special order items, custom bedding, or out-of-stock items. We do our best to deliver on a timely basis, but we are sometimes dependent on suppliers and cannot be responsible for delays beyond our control.

4. DAMAGE or DEFECTIVE MERCHANDISE CLAIMS: All our items are carefully inspected prior to packing. Report any damaged or defective items within 3 days to 1-800-798-1504 or 973-347-8392.

5. RETURNS & EXCHANGES: Special order, custom bedding, clearence items, and fabric yardage sales are final and cannot be returned or exchanged.

For all other items, please contact our office regarding all exchanges and returns. Call 1-800-798-1504 or 973-347-8392 to obtain a return authorization. Authorized returns or exchanges may be returned at your expense within 30 days of receipt. All returns MUST be unused, in their original condition, and in original packaging.

Return instructions will be provided. Any returns received without authorization or not in original condition or packaging will be refused and returned at buyer's expense.

Returns: We highly recommend ordering fabric samples to preview our products and to avoid the inconvenience of returning merchandise. If merchandise is returned within thirty (30) days of receipt in original condition and in the original packaging (no exceptions), a credit card refund will be processed after the application of a 20% Restocking Fee or a Store Credit will be issued for the full amount of the purchase. Returns that are not in perfect condition are considered canceled and no credit will be issued.

Returned samples: If sample merchandise is returned within thirty (30) days of purchase in original condition and in original packaging (if any), we will credit your card for the cost of the product plus any outbound shipping charges.

Exchanges: Provided the item(s) arrives unopened and in the original packaging, we will credit or bill your credit card for the price difference of the exchange merchandise.

6. CANCELLATION: Special order and custom bedding are made-to-order items; therefore, the deposit monies are forfeited. If we have begun work on the item, cancellations are not allowed. Cancellation of all other items must be reported immediately. Full credit will be issued unless Defining Elegance LLC is charged any administrative fees by our suppliers, in which case, we will issue credit less the imposed fees. If an order has already shipped and the delivery is refused, refused orders will be credited less all shipping and administrative fees.

7. SHIPPING CHARGES:
Shipping is free on purchases over $200 for shipping to the US and Canada only. All other countries will be charged an additional shipping charge to be determined at the time of shipping. Any customs fees are the responsibility of the buyer.
